Clark Kissinger Update

We have just learned that the motion to stay Clark Kissinger's sentence of 90 days in jail for probation violation has been denied. We expect Ron Kuby, Clark's lawyer, to appeal this decision to the 3rd Circuit Court of Appeals. People are outraged that this leading organizer in the movement for justice for Mumia Abu-Jamal is in jail.

While this motion denial is a setback, the telephone calls and faxes from people around the country have definitely made a difference. Kuby's office told us earlier today that the Bureau of Prisons received a record number of phone calls protesting Clark's sentence. Coming off of all these calls, including one from the office of a congress person, we hardly think it's a coincidence that the Warden himself interviewed Clark this morning.

Later, Karl Baker from the Philadelphia Defenders Association went in to see Clark and he reports that despite having been held in an isolated top security section of the prison, placed in shackles when taken from his cell, and strip-searched twice, he's in good spirits and sends greetings and thanks to all. After the stay was denied, Clark's Philadelphia attorney consulted with him and reports that he's now out of isolation and in the general population.

Clark's wife Judy has also been trying to get in to see him, but the officials initially said she couldn't see him until Saturday, the next official visiting hours. However, because of all the attention drawn to this case, the warden has agreed to allow her to visit Clark Friday morning.

We are still asking people to call and demand Clark's release:

Mayor John Street: 215.686.2181
Congressman Chaka Fatah: 202.225.4001
US Marshall's office: 215.597.7273
Judge Arnold C. Rapoport: 610.776.0369; fax, 610.776.0379
Judge Bruce Kaufman: fax, 215.580.2281

Word is getting out about Clark's outrageous kidnapping. Frances Goldin, Mumia's literary agent, who was in the courtroom, spoke on Amy Goodman's Democracy Now! Pacifica radio show this morning. This afternoon, Debra Sweet who works with Clark and is in the R&R! Mumia Working Group was heard on a WBAI newscast. Judy Kissinger was interviewed by KPFA's Flashpoint, a Pacifica radio station in the San Francisco Bay Area. The Independent Media Center (www.indymedia.org) posted a photo of Clark speaking at the RNC protests and an article about what happened in the courtroom. Also, check out www.ratm.com to read the article Rage Against the Machine posted on their website.

All this is happening in the midst of Mumia Awareness Week, culminating with the December 9th International Day of Solidarity with Mumia Abu-Jamal! Let's take this outrage and protest against Clark's sentencing to fuel the movement to stop Mumia's execution. Mumia is fearless so are we! We won't stop until he's free!
