Court Update
We all had quite a day in court. This is a brief reportback from what happened today in Rm 305 in front of Judge Deleon at the Broad and Spruce trial:
- 44 total defendants
- 2 bench warrants issued for defendants who did not appear in court
- 38 defendants had charges dismissed because of lack of prosecution
- 4 defendants went to trial: 1 dismissed because of lack of proper identification; 1 found guilty of summary charge of obstruction of a highway and sentenced to 50 hrs of community service and a $350 fine (filed for appeal); 2 found guilty of misdemeanor charge of obstruction of a highway and sentenced to 350 hrs of community service and $500 fine (both filed for appeal)
Points of interest:
- Three defendants went "pro se" (pro se means you defend yourself, with the assistance of a lawyer if you want) They rocked! Way to go Patrick! Zeke! Theresa! All pro se defendants addressed issues of our message, solidarity, and the creditibility of the prosecution's case!
- Many defendants wore statements on their clothing
- 1 defendant made a statement at time of sentencing
- Supporters and defendants in the courtroom repeatedly raised their fists in solidarity with those being convicted and during the arguments made by the pro se defendants
- After the prosecution rested, the defense lawyers motioned for acquittal for their clients that were not identified by the prosecution. The judge granted this motion for those defendants, but one pro se defendant would not motion for their own acquittal, because they wanted to stay in solidarity with other R2K defendants still in the system, especially those facing felony charges. The judge became incredulous, fired the pro se defendant, and appointed the back-up counsel. However, the pro se defendant then istructed their new counsel not to motion for acquittal, so the judge finally forced the prosecution to drop charges.
- The reason the judge found two guilty of misdemeanors was because they were in lockboxes, while the defendant not in a lockbox was given a summary conviction
- The selective prosecution motion was denied because the judge claimed we "had no message" despite numerous testimony given and arguments made concerning what our message was
- Despite the three convictions, today's experience in court was powerful.
