Court Update
All cases were heard in room 806, Judge Kirkland.
A non-consolidated misdemeanor case was discharged because witness for prosecution (cop) failed to appear.
First Consolidated trial: 300 S. Broad.
4 defendants with one charge of obstructing a highway. The first two defendants had their cases dismissed before trial because the witness for the prosecution (a cop) could not identify defendants.
The second two defendants had their trial heard. The prosecution presented video evidence and on the video tape he pointed out the two defendants. There was no pause on the VCR and the camera was just scanning a whole group of protestors. The prosecution did not call to the stand any arresting officer or any officer that could identify the defendants. The defense argued lack of proper identification and selective prosecution. The two defendants were found not guilty on lack of proper identification.
The defendants made statements to the press.
