Court Update
Most of the defendants from the 300 N. 16th St. group who were charged with blocking the on-ramp to 676 and on video tape doing so were acquitted of all charges by the infamous Judge Seamus Mccaffery, the same judge whom two recusal motions were filed against earlier in the week. He denied the one motion and continued the hearing on the other motion. Because of these motions a lot of media and public pressure was put on McCaffery. He knew everyone was watching him, and he responded in our favor, in a big way. I hope everyone understands what a huge win this was on our part. We are going to go forward with the motion because despite McCaffery's performance on Friday he is still a biased judge who will continue to allow police testimony to go unquestioned. The people we are most concerned with, of course, are those most at risk.
In this case those are the people with high level misdemeanors who all go in front of him. He has already sentenced two to jail time. One of those defendants had their municipal court trial last week where assault charge was dropped by Judge Denby and they were only found guilty on the lower level misdemeanor charge of blocking an intersection. This defendant started out in the system with felony charges, therefore we also consider this a win.
