Various Updates

1. The Timoney 3, Trial Date: TBA

The appeal made to Superior Court by the prosecution was granted last week. This means that a tribunal of judges ruled that the Common Pleas Court judge made a "mistake" in throwing out many of the defendant's charges. The defense attorneys are appealing this decision to a higher court. This process, again, is a lengthy one.

Background

The three people were charged with felonies for allegedly being involved in an "altercation" with (now former) Philadelphia Police Commissioner John Timoney. The charges have yet to be borne out with any kind of evidence, and many of the felonies were thrown out in Fall 2000 in Common Pleas Court. Timoney and the District Attorney, publicly agitated by this, appealed to Superior Court.

2. The Van Case 8, Trial Date: TBA

The six defendants who chose to appeal the guilty verdict of MC Court to Common Pleas Court had their charges thrown out before trial in a Motion to Quash. The prosecution, however, appealed this decision. Next Court date TBA. The two defendants who appealed by a Writ of Cert (an appealing of the judge's ability to make a fair ruling) have no trial date yet.

3. Two Misdemeanors, Trial Date: April 2002

The Common Pleas Court trial date of two Misdemeanor cases is in April 2002. These two defendants were convicted at an MC trial, however they have appealed to Common Pleas Court.

4. Civil Suits

Don't worry, you have not heard anything about them because not much is happening. This, again, is a long process.

Puppet Kids: If you were arrested in the warehouse and are interested in joining the suit but have yet to receive a contract, or lost your contract, call us right now and leave your mailing address in the voice mailbox. Everyone who did send in a contract should receive a phone call from us by next week. If you don't, it means we have the wrong number. So call us, and tell us the right one. We are hoping to schedule depositions for March 2002.

Everyone Else: We have not forgotten about everyone else. As soon as the Puppet Kids have their depositions scheduled, we will begin to work on everone else's civil suits. Expect activity in late Spring, early Summer 2002. The best you can do is contact us if you have never received a questionnaire, let us know if you will be unable to be contacted for months at a time, or if your address/phone number changes.

Also, we are always in need of more people to come to Philadelphia to work on the cases or support R2K Legal in other ways. One possibility is for current students to setup an unpaid intership or workstudy over the Summer to work on the Civil Suits.

5. Party for the Public Defenders!

We are working on a big thank-you party for the Public Defenders who have been so amazing, in particular Shawn Nolan. We are tentatively planning for March 2002. We would like to see as many of you as possible, we will keep you posted.
