Court Update
A Recusal Motion was filed in front of Judge Seamus McCaffery on Jan 16th by the PD's office regarding statements McCaffery
made at a panel discussion at University of Pennsylvania. However, McCaffery
did not let any witnesses testify, he did not take the stand, and he denied the motion.
Mark Rifkin and Danielle Redden (two 15th and JFK defendants) filed
a suplimentary Recusal Motion as pro se defendants. They filed
this motion on behalf of all defendants who were to have their cases
heard in front of McCaffery. The lawyers also signed on to it. The motion
demanded McCaffery's Recusal because of his 20 year term as a police
officer, his membership in the FOP (Fraternal Order of Police), his being Grand Marshall of
the Daniel Faulkner Memorial Motorcycle Run, and his history of
questionable civil disobedience convictions, etc., that
lead to the appearance of impropriety or bias.
We were allowed to make limited arguments. McCaffery stated he did not feel he had adequate
time to hear our motion, and therefore continued our argument to January
30th in Rm 603 at 1pm. He also stated that the other lawyers COULD
NOT sign onto our motion, nor could we file it on behalf of other
defendants (which is something that lawyers and pro se litigants are allowed to do all the time).
