Court Update

A felony defendant accepted a plea offer of guilty to F3 Aggravated assault on an officer with no jail time. The defendant was given 2 years reporting probation.

Another felony defendant had their prosecution withdrawn for lack of evidence.

Three felony defendants and one remand had their hearings concerning their motions to quash (throw out some or all of their charges). All these motions were denied. There are 14 felony defendants remaining. Six remand defendants with high-level misdemeanor charges remain. There are approximately 60 misdemeanor defendants remaining.

Two misdemeanor co-defendants started their trial (one of the these was arrested while serving as a legal observer). This trial will continue on February 23, 2001.

Our lawyers and two pro-se defendants filed a recusal motion in regard to Judge Seamus McCaffery, who is hearing the three remaining misdemeanor group trials, and the remaining remand cases. The motion will be argued on the January 16, 2001, at 3:00pm in Rm. 603. Judge McCaffery is being requested to recuse himself from the RNC cases because of public statements he made alluding to his involvement in a plan to keep RNC protestors in jail for the whole week of the convention, and also because of the fact he is an ex-cop, FOP (Fraternal Order of Police) member, and having a history of bias on civil disobedience cases. More information on this motion will be forthcoming.

The next trial is a group misdemeanor trial for those charged with regard to 300 N. 16th St. It will be in Rm. 603 on Friday, January 19, 2001. If you have any questions please call the legal office at 215-925-6791.
