R2K LAWYERS TO ARGUE MOTIONS IN COURT TUESDAY, NOVEMBER 28 FOR
DISMISSAL OF
CHARGES BASED ON "OUTRAGEOUS POLICE MISCONDUCT," "PRIOR RESTRAINT,"
"SUPPRESSION OF EVIDENCE," AND "POSSESSION OF AN INSTRUMENT OF CRIME"
WHO:
R2K lawyers will argue several motions on behalf of RNC defendants and
call
multiple expert witnesses to the stand in order to testify on behalf of
the
defense.
WHAT:
In an attempt to have charges thrown out, R2K lawyers are going to
argue
and explain how evidence in the form of puppets, signs and banners was
confiscated preemptively, then destroyed illegally. In another
argument,
R2K lawyers will charge that State troopers in conjunction with city
police
arrested people before they had a chance to utter a single word or
commit
any crime.
The motion to dismiss on the grounds of "Outrageous Police Misconduct"
will
provide arguments indicating that law enforcement acted impartially,
inappropriately, and illegally. Police actions violated due process
and
therefore taint the entire prosecution. Much of this argument is also
based
on the use of infiltration.
Perhaps the most controversial argument is a motion to dismiss charges
based on "Possession of an Instrument of Crime." In an attempt to
extend
speech on the streets on August 1st, the day of mass arrests, many
activists wore devices called lock boxes that prolonged their civil
disobedient activity. Expert witnesses will be called to the stand to
defend the use of these devices as nothing more than an extension of
one’s
voice or body and not an instrument of crime.
