Legal FAQ
Please note: This is a now outdated list of Frequently Asked Questions (FAQ) written by R2K defendants along with answers supplied to the best knowledge of those who prepared this FAQ. Obligatory disclaimer: We are not lawyers, and thus cannot give out legal advice. For all legal questions you need to contact a lawyer. The following information was collected from various sources and we cannot be held liable for it. We urge defendants to contact their lawyer with any questions.
[editor's note: this information was compiled by the a1 NY-area working group, and was current as of 9/27/00.]
Section 1: Who, What, Where
Who is R2K Legal?
The R2K Legal Collective is comprised of:
A) Activists
B) working groups composed of activists (such as Outreach, Fundraising, and Media)
C) the Legal Strategy Group (a closed group of attorneys, defendants, and supporters that has access to some confidential information but is not authorized to make decisions for the entire collective without approval)
D) the Legal Team (criminal and civil lawyers who have volunteered or are paid to work on these cases, including PA public defenders, PA private attorneys, NY private attorneys, and national criminal law experts)
The A group (activists) has the authority to consense on proposals that come from groups B and C. The collective has open meetings every Tuesday night at 7:30 PM at 1501 Cherry Street, Philadelphia, PA. Tuesday meetings include reports from the defendants' meeting, working groups, meetings in other cities and regions, and the legal strategy group. Defendants (from all cities) have the last word on decisions affecting them.
Who are the lawyers involved?
At this time, the Legal Strategy Group contains:
- 2 PA private attorneys, Larry Krasner and Paul Hetznecker
- 2 NY private attorneys, Anastasia [last name?] and Ron McGuire (who also works for SLAM)
- 1 NJ private attorney, King Downing
These lawyers are committed to the progressive political goals of many of the protesters and are willing to utilize solidarity as a tactic for achieving the group's goals. There are lawyers that have been working with the collective who are not in the Legal Strategy Group. Among them are:
- Jules Epstein (PA criminal attorney)
- David Rudovsky (Civil Suit guru)
- Roy Zipris (from NLG and Public Defenders office)
- Andy Erba (PA attorney)
The R2K Legal Collective continues to seek lawyers who want to volunteer resources for the defense of the Philadelphia arrestees. The Public Defenders Association (PDA) has three lawyers that are representing most of the arrestees:
- Shawn Nolan (215) 557-4995 nolanshawn@hotmail.com
- Bradley Bridge (215) 557-4960
- Meg Flores (215) 557-4960 or (215) 972-4524
...have taken these cases, and they are receiving orders from Charlie Cunningham, the second in command at the PDA. If you are represented by the public defender, you can call the PDA to find out which of these lawyers are yours (Meg, Bradley, or Shawn), and you can speak to your lawyer about your case if you have any questions. The public defenders will be answering questions for defendants all day on Thursday and Friday before each status hearing. [editor's note: please see this page for current PDA contact info.]
How do I get my own lawyer?
At this time the collective does not have a private lawyer to represent every defendant for free. Some of the lawyers in the collective have taken clients who are able to pay, and some have taken cases for free. If you want a referral for a criminal lawyer for your case, call the R2K Legal Office or directly contact one of the private attorneys involved.
How do I contact R2K Legal and the Public Defender?
The R2K Legal Collective can be contacted at 215-925-6791. The Public Defender Association can be contacted at 215-557-4960.
Where are the R2K Legal Office, the Public Defender's Office, and the Court House?
The R2K Legal office is located at 1524 Race Street, Philadelphia, PA. It is open Monday through Friday from noon to 7:00 PM. This is the former location of the R2K medical team. The Public Defender Association is located at 17th Street and Arch Street, SW corner. The court house, the Criminal Justice Center, is located at 13th Street and Filbert Street, NE corner.
Where can I find more information about our cases and about solidarity?
There will be training and solidarity discussions in New York City and Philadelphia before each of the Saturday status listings. If you want to plan and be a part of solidarity, it is very helpful to be at one or all of these meetings. In Philadelphia, there will be solidarity discussions among defendants at 6:00 PM on every Friday and Saturday surrounding each status listing. Thus the first meeting will be on September 15. The meetings will be at WILPF, which is located at 1213 Race Street (by 12th street). It is important for defendants to find out as much about their cases as possible, because we can't rely on lawyers to tell us what is possible and what will happen to us if we get creative with the legal process. The R2K legal team has experience with political legal strategy.˜]
